In these terms and conditions:
- Agent means New Zealand Care, or the person arranging an accommodation
service for the Client or the Client's student, whichever may be the case.
- Host means a person or persons contracted by the Agent to provide an
accommodation service for a Client (or Clients) of the agent.
- Homestay means the provision of home stay accommodation to an international
student who is herewith referred to as a Client (or Clients) of the Agent .
- Client means the person or student specified as receiving an accommodation service provided by the Host, as contracted by the Agent.
- Placement means the act of placing a Client with a Host for the purpose of
accommodation.
- The agreement and contract for hosting between the Agent and the Client is
subject to these terms and conditions and, as applicable, New Zealand laws.
These terms and conditions apply, except to the extent of any inconsistencies
with any applicable New Zealand laws, in which event such laws will prevail, to
the extent of the inconsistency.
- The Agent will take reasonable care and skill to give effect to the directions
given to it in this authority and to the New Zealand Code of Practice for the Pastoral Care of International Students.
- The Agent accepts no responsibility or liability for the accuracy of personal
information provided to the Client, which has been obtained from the Host.
- This agreement and the benefits of the contract for hosting services between
the Agent and the Client is not transferable by the Client. The Client is responsible to
obtain an accurate translation of this agreement into his/her ethnic language.
- The Client acknowledges that the Agent may have to cancel or delay an
accommodation placement due to unknown factors or any event beyond the
Agent's reasonable control, and rescheduled placements are not guaranteed.
To extent permitted by applicable laws, the Agent will in no circumstances be
liable for any losses which a Client may incur as a result of a delayed or
cancelled placement, or postponed or cancelled hosting arrangement.
- Clients must comply with all applicable laws, statutes and regulations relating to
the accommodation of international students and accommodation of boarders, all
New Zealand Immigration Laws, and all conditions and instructions of the Agent.
- Subject to the provisions of these Terms and Conditions of Homestay, and any
applicable New Zealand laws, the Agent is not liable for or in connection with
any of the following:
- Personal, financial, or personal property Loss sustained through Client negligence, ignorance of New Zealand Laws, or dangerous or unlawful behavior and actions
- Illness, injury or death of any person, including (without limitation), any Illness, personal injury or disability to a Client, (or Host), caused by, or aggravated
by the placement or homestay agreement, where such placement or homestay
posed a risk to the Client due to the Client's age, physical or mental condition.
- Loss caused by a Host's negligence, dangerous or unlawful behavior and actions, or breach of these terms and conditions, or the Host's failure to comply with applicable laws, statutes, and regulations of New Zealand.
- Clients are responsible to provide the Agent with all required updates and
changes to the Client's current and existing personal information record which
is held by the Agent. This information includes the following:
- Location of study or change in education provider.
- An illness (mental or physical), or disability through accident or sickness.
- A criminal conviction or pending criminal charges.
- A change in immigration status, or a cancellation of visa.
- The Client may terminate a homestay service by giving two weeks advance
notification to the Agent in writing, and clearly stating in writing the reason for
termination of the homestay agreement. The Client may not enter into any private
or further agreement with a Host who has been introduced to the Client by the Agent.
The Client is bound by contractual obligation not to enter into an agreement with the
Host, to the exclusion of the Agent, which obligation survives the termination of the
agreement.
- The Client is bound by contractual obligation, not to enter into any private or
further agreement with any person or persons introduced to the Client by the Agent,
or introduced to the Client by the Host (either directly, or indirectly), to the exclusion
of the Agent, which obligation survives the termination of the agreement.
- The Agent reserves the right to charge the Client a late payment fee if a homestay
payment does not arrive by the date specified on the Agent's invoice. This penalty
fee will not exceed $5.00 New Zealand dollars per day for each day overdue (past the due date on the invoice)
- If a Client wishes to extend an accommodation period, a minimum of one extension
at the regular weekly homestay rate is allowed, after this any further extension of the
accommodation will be charged at our Extension Rate which is $50.00 per day
(Auckland), and $40.00 per day (Christchurch). If the Client/student will be away
from the homestay for more than 6 days at any time during the school year, the
Client will be charged a Homestay Retainer Fee of 35% of the regular weekly rate.
- In the case of a breach of these terms and conditions by the Client, the Agent retains
full legal right to obtain compensation from the Client. This compensation will be
proportionate and/or reflective of the actual loss, or potential loss, which has been, or
will yet be incurred by the Agent as a result of the Client's breach of any of these
terms and conditions, as well as any associated legal costs. The Agent may, in his
absolute discretion, waive, alter or lower the amount of compensation claimed.
- These terms and conditions of homestay may not be altered, modified or waived by
any person, excluding the Agent or representative(s) of the Agent.
